Terms and Conditions
All Members (defined below) visiting a Surrenne club (“Surrenne Club”) agree to be bound by these terms and conditions (“Conditions”) and by any other rules or instructions that we may issue (in our absolute discretion) from time to time with regards to such Member’s use of a Surrenne Club. In these Conditions, “Surrenne”, “we”, “us”, “our” means Maybourne Hotels Limited.
Any Member who fails to comply with all these Conditions, all the rules of the Surrenne Club in force from time to time and the instructions of the Surrenne Club’s management or, in our reasonable opinion conducts him or herself at the Surrenne Club in an unbecoming manner or whose conduct does or might bring the Surrenne Club into disrepute, may in our absolute discretion be removed and/or denied access to the Surrenne Club or have their membership immediately terminated on written notice from us. Any person whose membership is terminated in this way shall not be entitled to enter the Surrenne Club’s premises as a guest of any Member or otherwise unless and until readmitted as a Member in accordance with these Conditions.
1 ENTITLEMENT TO USE THE FACILITIES
1.1 Admission to a Surrenne Club and its facilities (including, without limitation any swimming pool, sauna and steam rooms, gymnasium, treatment rooms and all other ancillary facilities contained at the applicable Surrenne Club) (the “Facilities”) is restricted to: (i) those with a membership that entitles them to access the relevant Facilities; and/or (ii) authorised residents of The Emory, The Berkeley or any other hotel approved to access Surrenne from time to time, each, a “Member” for the purposes of these Conditions.
1.2 Those under the age of 16 are only permitted to use the Facilities where they are accompanied, and continuously supervised, by an adult Member. Such use is restricted to the following times: Monday to Sunday 8:00am to 10:00am and 4:00pm to 6:00pm.
2 OPENING AND CLOSURE OF THE FACILITIES
2.1 The hours of opening of the applicable Facilities will be determined by us from time to time and posted at the applicable Surrenne Club reception desk, online and on the Surrenne app.
2.2 We will endeavour to keep the Facilities operating during published opening hours but Members acknowledge that certain Facilities and/or the Surrenne Club may be unavailable from time to time (or subject to certain limitations or restrictions), including for necessary cleaning, decorating, or repairs or for reasons beyond our control (such as damage to the Facilities, unavailability of staff or by order of any public authority).
2.3 We reserve the right to close the Facilities or any part of them at any time for any purpose without notice.
2.4 We shall have the right at any time, to terminate the use of the Facilities by a Member. We will be under no obligation to make known the reason for the termination of any membership.
2.5 Whilst we will endeavour to minimise disruption to Member’s use of the Facilities and give advance notice of any closures, we have no liability to Members in respect of any disruption caused.
3 MEMBERSHIP CARDS
3.1 Your membership card or other must be in your possession at all times and will be scanned on arrival (unless otherwise agreed).
3.2 If you are not in possession of your membership card you must check in with a member of Surrenne Club staff at reception.
3.3 You are responsible for ensuring that no one else uses your membership (including your membership card) and you must inform us immediately if you lose your membership card.
3.4 Membership/security access being given to another person is a breach of these terms and will result in an immediate termination of your membership.
4 MEMBERSHIP RULES & POLICIES
4.1 You acknowledge and agree that:
4.1.1 the Facilities are exclusively for Members;
4.1.2 you shall comply with all instructions and/or recommendations given to you by, or on behalf of Surrenne regarding the use of the Facilities;
4.1.3 if you have any doubts about your abilities or the appropriateness of your use of the Facilities through general condition, injury, or other reason, such as pregnancy, you must consult a doctor prior to using the relevant Facilities and inform an appropriate member of staff at the Facilities;
4.1.4 you must not use any of the Facilities if suffering from any infectious or contagious illness, disease, or other ailment such as open cuts, abrasions, open sores or minor infections where there is a risk that such use may be detrimental to the health, safety, comfort or physical condition of other Members;
4.1.5 only members of staff or a third party agreed by Surrenne may provide personal training services within the Facilities and you may not bring a personal trainer to the Facilities in a professional capacity, even as your paying guest;
4.1.6 with the exception of guide dogs, pets are not permitted at any Surrenne Club (unless otherwise approved by Surrenne);
4.1.7 smoking and vaping is not permitted at any Surrenne Club;
4.1.8 only food purchased from Surrenne can be consumed at the Surrenne Club;
4.1.9 no alcoholic beverages or drugs of any kind may be brought into the Surrenne Club (Members who are or who appear to be under the influence of alcohol or drugs shall not be permitted access to the Surrenne Club or the Facilities (as the case may be) or may be required to leave;
4.1.10 calls may be made on mobiles while in the reception areas only;
4.1.11 you are responsible for the conduct of your guests at all times;
4.1.12 you shall not take photos or videos of other Members in the Surrenne Club and are to be considerate of other Members when using a mobile phone (no video calls, or calls on speakerphone);
4.1.13 no glass containers may be taken into any fitness areas, pool, or changing areas; and
4.1.14 you shall comply with all Surrenne Club health and safety policies, procedures, rules and regulations, as notified to you from time to time.
4.2 If robes and slippers are required for your visit, please wear under garments beneath your robe. We also offer disposable undergarments for both men and women. Our therapists are trained in professional draping to cover you appropriately during treatments to maintain your privacy. T-shirts with comfortable trousers or shorts are ideal fitness attire. Trainers must be worn in the gymnasium.
4.3 Lockers are provided in the changing rooms for personal items; however, we advise you not to bring money or wear valuables whilst using the Facilities. All items are left at your own risk, and we do not accept any liability for loss of or damage to such items.
4.4 Any items left at the Surrenne Club at the end of each day will be treated as lost property and sent to security.
4.5 Inappropriate or aggressive behaviour towards staff will not be tolerated.
5 BOOKINGS FOR CERTAIN FACILITIES, TREATMENTS OR CLASSES
5.1 Additional charges may be payable for using certain of the Facilities, as we may notify you from time to time. Tariffs are available from Surrenne upon request.
5.2 Please book appointments prior to your arrival at the Surrenne Club, so that we may best accommodate your needs and to avoid disappointment should we be fully booked.
5.3 We require 24 hours’ notice to re-schedule or cancel your reservation. Reservations made within the 24 hour period are confirmed and cannot be changed or cancelled. All cancellations must be made through Surrenne, either in person at the reception desk, by phone, online, or through the Surrenne app.
5.4 Please arrive at least 15 minutes prior to your scheduled appointment time. Appointments and classes begin and end on time in order not to disrupt the scheduling for other Members.
6 TREATMENTS
6.1 Holistic consultations are carried out before all treatments. Please be aware that some treatments are not suitable for certain conditions, and it is in your best interests if we suggest an alternative treatment. Always consult your doctor first about any concerns you may have about your health, in certain cases written permission will be required by either your GP/Specialist or a ‘Personal Disclaimer’ will need to be signed prior to any treatments being conducted.
6.2 Please inform us if you suffer from any allergies, sensitivities, high blood pressure, diabetes, a heart condition or any other physical ailments or injuries at the time of your reservation to allow the best possible treatment experience for you. We have treatments designed specifically for expectant mothers. Please notify us when making a reservation if you are pregnant and we will guide you through the treatments suitable for you.
6.3 All persons under the age of 16 wishing to have a treatment or use the Facilities are regarded as minors and must be accompanied by a parent or legal guardian.
7 SWIMMING POOL
7.1 You acknowledge and agree that:
7.1.1 there is not a permanent lifeguard in attendance at any swimming pool or the areas surrounding it;
7.1.2 our swimming pools are not monitored by CCTV, please abide by the Swimming Pool Safety Code (being Surrenne’s swimming pool safety codes notified to the Member or otherwise displayed at a swimming pool within a Surrenne Club) for your safety;
7.1.3 children under 16 years of age must be always supervised by an adult (18 years and over);
7.1.4 the maximum number of children under 16 years of age that one adult can supervise at a swimming pool is three;
7.1.5 children of nappy wearing age must wear swimming nappies at all times;
7.1.6 children using flotation devices (e.g., arm bands, rings) must be closely supervised with the parent or guardian in the water with them at all times;
7.1.7 people under, or who appear to be under, the influence of alcohol and drugs will not be permitted to access the swimming pool or surrounding areas;
7.1.8 diving, running, jumping, pushing and rough play are not permitted at the swimming pool;
7.1.9 you must shower immediately before and after using the swimming pool;
7.1.10 no glass or crockery is to be taken into the swimming pool or surrounding areas;
7.1.11 no outdoor footwear is permitted at or around the swimming pool unless adequately covered (shoe covers may be provided by Surrenne);
7.1.12 a person suffering from a known serious medical condition such as heart conditions, diabetes, epilepsy, or respiratory problem must seek medical guidance from a doctor before swimming and shall make the staff on duty at the swimming pool and/or the Surrenne Club aware; and
7.1.13 anyone suffering from an open wound, sore, infected eyes or any discharge from ears or nose will be refused entry.
8 GYMNASIUM
8.1 You acknowledge and agree that:
8.1.1 entry to the Facilities is gained on presentation of your Membership Card, or by providing your name at the Surrenne reception desk on arrival;
8.1.2 appropriate exercise clothing must be worn when using the gymnasium (e.g. tops must be worn at all times);
8.1.3 bags and coats are not permitted in the gymnasium;
8.1.4 in the interest of hygiene and safety, please wipe down equipment after use and ensure all equipment is placed back in the racks provided;
8.1.5 no glass containers, hot beverages or food are allowed in the gymnasium or studios;
8.1.6 in the event of an incident or accident, please report it immediately to the manager on duty. Where necessary, incidents will be referred to a third party and will be investigated in detail;
8.1.7 you must complete a personal training questionnaire and agreement prior to commencing a personal training session;
8.1.8 you will not leave bags or personal items in the lockers overnight as lockers are emptied every evening for cleaning; and
8.1.9 you shall refrain from taking photos or videos in the changing rooms to respect the privacy of all Members.
9 HEALTH AND SAFETY RULES AND LIMITATION OF LIABILITY
9.1 Specific instructions for the use of each facility are displayed in the appropriate area, the welcome desk, online or through the Surrenne app. These must be read carefully before use of the Facilities and strictly adhered to. Subject to the paragraphs below, we accept no liability for a Member’s failure to observe these instructions and accordingly use of these Facilities will be solely at the risk of Members.
9.2 Subject to the clauses below, we accept no liability for any illness or injury resulting from:
9.2.1 use of the Facilities by Members; and/or
9.2.2 over exertion, or precipitation or aggravation of a medical condition caused by such use.
9.3 All persons who use the Surrenne Club do so on the express basis that it is at their own risk. It is recommended that Members seek medical advice before undertaking any exercise in the Surrenne Club or using any of the Facilities.
9.4 Nothing in these conditions or the rules of the Surrenne Club shall limit or exclude our liability to Members or guests for death or personal injury caused by our negligence or for fraud or fraudulent misrepresentation.
9.5 The Surrenne Club must be vacated whenever requested by the management, or in the event of a fire alarm.
9.6 We reserve the right to require a Member to leave any Facility (such as the swimming pool) if that Member is in our opinion causing a disturbance.
10 TERMINATION OF MEMBERSHIP
10.1 For the avoidance of doubt, the following (non-exhaustive) list of behaviour or offences by a Member will lead to the immediate expulsion of a Member from the Surrenne Club and/or its Facilities and may lead to suspension or termination of their membership:
10.1.1 violent, abusive, disrespectful or intimidating conduct to any person, including but not limited to other guests or staff;
10.1.2 sexual, racial or any other form of discrimination, harassment or bullying towards any other Member or employee of the Surrenne Club;
10.1.3 rudeness or bad language to a Member or an employee of the Surrenne Club;
10.1.4 any action likely to bring the Surrenne Club into disrepute;
10.1.5 serious insubordination under the influence of alcohol;
10.1.6 deliberate damage to Surrenne Club property;
10.1.7 use of illegal drugs; or
10.1.8 any action, within or outside the Surrenne Club, likely to cause a disturbance to residents in neighbouring properties.
11 GENERAL
11.1 We may change, vary or revoke these Conditions (in whole or in part) at any time at our sole discretion.
11.2 These Conditions and any dispute or claim arising out of or in connection with it (including any non-contractual claims or disputes) shall be governed by and construed in accordance with the laws of England and Wales and the parties irrevocably submit to the exclusive jurisdiction of the English courts.
